AS CONSIDERATION FOR GREENBERRY INDUSTRIAL LLC'S ("GREENBERRY") REVIEW OF MY APPLICATION FOR EMPLOYMENT, I AGREE, EXCEPT AS OTHERWISE PROVIDED IN THIS SECTION, ANY AND ALL CLAIMS OR DISPUTES, ARISING OUT OF OR RELATED TO MY APPLICATION FOR EMPLOYMENT WITH GREENBERRY, WILL BE DECIDED BY A SINGLE ARBITRATOR THROUGH FINAL AND BINDING ARBITRATION AND NOT BY A JUDGE OR JURY, in accordance with the American Arbitration Association Employment Arbitration Rules ("AAA Rules") then in effect. The AAA Rules may be found at www.adr.org/employment or upon request to GREENBERRY. If there is a conflict between the AAA rules and this Agreement, this Agreement will govern. Disputes will be decided by mutual, binding, and individual arbitration governed by the Federal Arbitration Act (9 U.S.C. * 1 et seq.), and this agreement to arbitrate evidences a transaction involving commerce. GREENBERRY agrees to pay the fees and costs of arbitration, pursuant to the AAA Rules. The Arbitrator may award any remedy to which a party is entitled under applicable law, and remedies will be limited to those that would be available to a party in his or her individual capacity for the claims presented to the Arbitrator. Either party may file dispositive motions, and the Arbitrator will apply the applicable Federal Rules of Civil Procedure to decide such motions.
